An Ohio federal judge on Friday declined to certify a class of Marlboro Lights smokers on claims that Philip Morris USA Inc. deceptively pushed the brand as a low-tar, low-nicotine alternative, saying that class members acted inconsistently in choosing and smoking those cigarettes.

An Ohio federal judge on Thursday cleared Philip Morris USA Inc. and Altria Group Inc. of claims stemming from multidistrict litigation that they violated state consumer protection laws by advertising their cigarettes as "light," finding the plaintiffs couldn't sue under those statutes as consumers.
