Alpha Unit's Selenium Pollution Violated CWA, Judge Rules
A West Virginia federal judge on Thursday ruled that Alpha Natural Resources Inc. unit Marfork Coal Co. Inc. discharged excessive amounts of toxic coal mining byproduct selenium into waterways, saying water testing proved the company violated state mining laws and the Clean Water Act.

A West Virginia federal judge on Monday granted partial judgment to a coalition of environmental groups in their suit accusing two Alpha Natural Resources Inc. units of illegally discharging the toxic mineral selenium, ruling one of the companies had not adequately refuted the plaintiffs' claims.
