Coca-Cola and its attorneys at Shook Hardy & Bacon LLP on Monday blasted Ethox Chemical's bid for $3.5 million in attorneys' fees in a dispute over inventor rights in a packaging patent, disputing Ethox's claim that the attorneys committed misconduct and accusing it of taking "unreasonable" positions.

Following a judge's ruling last month that an Ethox Chemical LLC employee should be added as an inventor of a Coca-Cola packaging patent, Ethox moved Wednesday for $3.5 million in attorneys' fees over what it called "inexcusable" misconduct by Coca-Cola and its attorneys from Shook Hardy & Bacon LLP.

The Coca-Cola Co. urged a South Carolina federal court Monday to dismiss monetary damages claims by a company asserting that its employee is entitled to co-inventorship of a Coca-Cola packaging patent, saying damages are either foreclosed by the contract between the companies or preempted by federal law.
