The Dannon Co. Inc. on Thursday escaped a putative class action alleging Activia Yogurt cut with a milk protein is adulterated and no longer actually yogurt, after a New York federal judge determined the additive has not been prohibited by federal regulators.

A consumer lodged a putative class action against The Dannon Co. Inc. in New York federal court on Tuesday, accusing the company of illegally marketing its Activia products because they contain filler materials not listed in the U.S. Food and Drug Administration's standard of identity for yogurt.
