The Texas Racing Commission on Monday asked a Texas federal court to find state laws that bar online gambling but allow in-person wagers on horse races don't violate the constitutional commerce clause, in its response to a suit from Churchill Downs Inc. that seeks to overturn the online ban.

Churchill Downs Inc. and a subsidiary that operates the online betting site Twinspires.com sued the Texas Racing Commission in federal court Friday, arguing a state law unconstitutionally discriminates against online betting businesses by allowing Texas citizens to bet on horse races only in person.
