BMW of North America LLC on Friday said the named plaintiff in a proposed class action alleging the company improperly sells demonstration vehicles as new has suffered no damages and therefore lacks standing to pursue any of his legal claims, nor, as a nonresident, can he invoke the New Jersey Consumer Fraud Act.
