A Pennsylvania federal judge on Monday refused to dismiss AmerisourceBergen Corp.'s counterclaims alleging that a former employee who brought a False Claims Act kickback suit breached his contract by releasing confidential information, which allowed competitors to access trade secrets.

AmerisourceBergen Corp. was hit with a False Claims Act suit brought by a company insider on behalf of the U.S. and more than a dozen states, including California, New Jersey, New York and Texas, alleging a kickback scheme that offered inducements for startup pharmacies, according to a complaint unsealed Tuesday.
