5-Hour Energy Faker Can't Use False Ad Defense, Judge Hears
The maker of 5-Hour Energy drinks urged a California federal judge Thursday to throw out Dan-Dee Company Inc.'s claims that it should be excused for counterfeiting the beverage because the original's labeling falsely claims that it contains vitamins and amino acids that boost energy.

Pitco Denies It Knew 5-Hour Energy Drinks Were Fake
Pitco Foods Inc. on Thursday urged a California federal judge to toss claims that it illegally sold counterfeit bottles of 5-Hour Energy drinks, arguing that 5-Hour Energy owner Innovation Ventures LLC hadn't shown that the grocery chain knew the drinks on its shelves were fake.
