HSBC Bank USA NA asked a New York federal judge Tuesday to toss a proposed class action alleging it improperly maximized overdraft fees by processing customers' largest transactions first, saying its policy is transparent and allowed under the National Bank Act.

HSBC Bank USA NA was hit with a proposed class action in New York federal court Tuesday accusing it of deceiving customers by burying their costliest debit transactions on their statements and by not clearly telling them they had the right to opt out of its overdraft fee program.
