A Florida federal judge refused to grant a preliminary injunction Wednesday against Bausch & Lomb Inc. over its use of a Florida ophthalmologist's trademarked slogan, "See Better. Live Better," adopting the recommendation of a magistrate judge who felt such an order was unwarranted because the claims were likely to fail.

A Florida federal judge on Thursday found that an ophthalmologist's trademark claims against Bausch & Lomb Inc. over its use of the slogan "See better. Live better." were not likely to succeed and recommended that the doctor's motion for a preliminary injunction be denied.

Bausch & Lomb Inc. on Thursday fired back at a Florida ophthalmologist who sued the company for trademark infringement over its "See Better Live Better" advertising slogan, saying the suit is a meritless attempt to assert exclusive rights to the phrase.
