A California federal judge on Wednesday threw out a racketeering class action claiming Apple Inc. concealed a malfunction in the power button of its iPhone 4 and iPhone 4S devices, saying the alleged defect presented no safety hazards.

The plaintiff in a class action accusing Apple Inc. of concealing an iPhone defect pushed back in California federal court Tuesday against the company's bid to force the dispute into arbitration, saying his cellphone contract with AT&T Mobility LLC — and the arbitration clause therein — is not at issue in the case.

Apple Inc. on Thursday asked a California federal judge to compel arbitration of two putative class actions brought by consumers who say Apple and AT&T Mobility LLC formed a "racketeering enterprise" to market and sell Apple's iPhone 4 and iPhone 4S devices while concealing a defect in the products.
