A Delaware federal judge on Tuesday refused to award attorneys' fees to the BP PLC and DuPont joint venture Butamax Advanced Biofuels LLC, finding that its victory in a recent infringement suit over technology for an ethanol fuel alternative wasn't exceptional.

BP PLC and DuPont Co. joint venture Butamax Advanced Biofuels LLC notched a victory in its ongoing patent battle with Gevo Inc. when a Delaware federal judge ruled Friday that Butamax didn't infringe two Gevo patents covering technology for creating an ethanol-alternative biofuel.
