    A Massachusetts federal judge on Tuesday declined to let a restaurant patron smacked in the face by a runaway, 9-foot umbrella have a new trial on damages, saying she hadn't shown that the jury's damages award represented a clear miscarriage of justice.

    A harbor-side seafood restaurant negligently allowed a runaway, 9-foot umbrella to smack a diner in the face, a Massachusetts federal jury found Tuesday, but jurors rejected the patron's claim that her three children also deserved payment for the resulting lost time with their mom.
