A California federal judge on Tuesday refused to certify a class in a suit accusing American Databank LLC of issuing error-laden criminal background checks in violation of the Fair Credit Reporting Act, finding the proposed class representative unfit because of her extensive criminal history.

American Databank LLC has been hit with a class action accusing the Denver-based background check company of flouting federal laws designed to guard against inaccurate consumer reports, according to a suit removed to California federal court last week.
