The D.C. Circuit Thursday rejected the Electronic Frontier Foundation's bid to gain access to a legal opinion supporting a Federal Bureau of Investigation telephone surveillance program, finding that the opinion is exempt from disclosure under the Freedom of Information Act.

The Electronic Frontier Foundation on Tuesday asked the D.C. Circuit to reverse a lower court's dismissal of its Freedom of Information Act suit seeking a document containing the DOJ's legal advice to the FBI on a now-discontinued telephone surveillance program.
