A plaintiff alleging an antitrust conspiracy doesn't need to include all the possible co-conspirators as defendants unless they have an identifiable interest in a lawsuit, the Ninth Circuit said Monday in reviving a proposed class action claiming Apple Inc. illegally locked iPhone customers into AT&T Mobility LLC cellphone plans.

A proposed class of iPhone users urged the Ninth Circuit on Friday to revive their claims that Apple Inc. violated antitrust law by locking customers into AT&T Mobility LLC cellphone plans, saying that a lower court's dismissal for failing to add AT&T as a defendant "ignores three-quarters of a century of jurisprudence."
