    En Banc 9th Circ. Reverses Remand Of Teva Painkiller Suits

    The Ninth Circuit sitting en banc reversed a panel decision on Tuesday remanding to California state court dozens of coordinated, multiplaintiff lawsuits alleging the pain medication propoxyphene caused cardiovascular injuries, after Teva Pharmaceuticals USA Inc. and Xanodyne Pharmaceuticals Inc. argued the cases were properly removed to federal court.

    The Ninth Circuit on Monday agreed to take another look at its remand to state court of a lawsuit against Teva Pharmaceuticals Inc. that's part of a mass action over cardiovascular injuries allegedly tied to propoxyphene painkillers after the drugmaker argued that the decision created a troubling circuit split.

    The Ninth Circuit denied Teva Pharmaceuticals USA Inc.'s challenge of an order remanding to state court a lawsuit over cardiovascular injuries allegedly tied to propoxyphene painkillers, saying on Tuesday the plaintiffs' case coordination request didn't meet the requirements for removal under the Class Action Fairness Act.
