Pennsylvania hospitals on Monday pressed the Third Circuit to revisit its recent ruling that Medicare need not count patients in a state charity program when calculating disproportionate share payments for treating low-income residents, saying the court bought into a bogus distinction between Medicaid patients.

The Third Circuit on Wednesday overturned a district court's decision that the U.S. Department of Health and Human Services had deflated two Pennsylvania hospitals' so-called disproportionate share payments for treating low-income individuals by improperly excluding charity care patients from its disbursement calculations.
