A Maine federal court determined Monday that a state statute permitting the personal importation of pharmaceuticals from countries outside the U.S. is preempted by the federal Food, Drug and Cosmetics Act, granting a motion for summary judgment filed against the state by a group of pharmacists and related associations.

The Pharmaceutical Research and Manufacturers of America and two Maine pharmacists' groups sued the state in federal court Tuesday, alleging a state law allowing direct importation of prescription drugs conflicts with federal law and will expose Maine residents to potential harm from unregulated drugs.
