The Third Circuit on Friday reinstated a conviction that was thrown out by the U.S. Supreme Court last year of a Pennsylvania man who made violent remarks over Facebook, ruling that problems identified by the justices with the appellate court's test for determining true threats were "harmless."

The Third Circuit ruled Thursday that the difference between true threats and protected free speech doesn't hinge on whether a defendant subjectively intended his statements to threaten, upholding a Pennsylvania man's convictions for threats to his wife, law enforcement officials and others over Facebook.
