The Ninth Circuit ruled Thursday it didn't have jurisdiction over an appeal of a class certification denial for investors suing their former Milberg LLP lawyers, citing the U.S. Supreme Court's recent ruling in Microsoft v. Baker in a decision that may completely kill the investors' case.

The U.S. Supreme Court on Monday told the Ninth Circuit to reconsider its decision to reopen a proposed class action brought by investors against their former lawyers, including class action firm Milberg LLP, remanding the question of class certification in light of the high court's recent Microsoft v. Baker decision.

The Ninth Circuit on Thursday vacated a district court order denying class certification to investors accusing Milberg LLP of malpractice for missing key deadlines in a securities suit against an American International Group Inc. subsidiary, saying Arizona law applies even though the proposed class is dispersed throughout the country.
