A California federal judge handed a trademark win to Pom Wonderful LLC on Wednesday, saying Oregon-based beverage maker Pur Beverages Inc. couldn't prove the word "pom" was generic, while also ruling Pom Wonderful's use of a heart-shaped "o" did not deviate far enough from its "POM" trademark to constitute abandonment of the mark.

Pom Wonderful LLC urged a California federal judge Wednesday to rule that Pur Beverages Inc. infringed its trademark by using a "virtually identical" mark with the word "pom" to describe a pomegranate flavor, saying summary judgment should be an easy call given the likelihood of customer confusion.

A California federal judge, who the Ninth Circuit said had erred by denying an injunction bid by Pom Wonderful LLC, again rebuffed Pom's bid on Monday to block sales of Pur Beverages' allegedly trademark-infringing energy drinks, tentatively ruling Pom still hadn't shown Pur's sales are harming its brand.

A California federal judge on Friday declined a bid from Pom Wonderful LLC to block the sale of energy drinks sold by Pur Beverages that it says violate a trademark for its own line of juices, ruling that the competing marks are distinct enough that consumer confusion is unlikely.
