High Court Won't Hear Omnicare Whistleblower's FCA Case
The U.S. Supreme Court declined Monday to review the Fourth Circuit's dismissal of a former worker's whistleblower complaint accusing Omnicare Inc. of defrauding Medicare by selling contaminated drugs, preserving a sweeping decision that may sharply limit False Claims Act suits over quality control lapses.

The Fourth Circuit on Friday tossed a former worker's whistleblower False Claims Act suit alleging Omnicare Inc. violated federal regulations by selling contaminated drugs to the government, saying the employee didn't prove Omnicare made a false statement or knew it was engaging in wrongdoing.
