A Pennsylvania federal judge on Thursday threw out a health worker's collective action claims against West Penn Allegheny Health Systems over withheld meal break compensation, but she declined to sanction a Thomas & Solomon LLP attorney and the plaintiff for bringing a suit that mirrored an already decertified collective action.

West Penn Allegheny Health System filed a motion for sanctions against Thomas & Solomon LLP and its client in Pennsylvania federal court on Thursday, accusing the firm of "bringing a duplicative collective action" over meal break compensation against the health care operator.
