3rd Circ. Says Comcast Forces Class Cert. Redo In Ex-J&J Suit
The Third Circuit vacated class certification in price-fixing litigation against a former Johnson & Johnson blood test unit Wednesday, telling the district court to reconsider the ruling given the U.S. Supreme Court's recent decision requiring greater scrutiny of expert witnesses during class certification fights.

A Pennsylvania federal judge's order granting class certification in multidistrict litigation accusing a Johnson & Johnson unit of fixing prices of reagents used in blood tests was based on flawed expert testimony, the company told the Third Circuit on Wednesday.
