    5th Circ. Says Texas Law Trumps Toyota Faulty Air Bag Suit

    The Fifth Circuit on Monday tossed a widower's suit against Toyota Motor Corp. alleging that defective air bags in his wife's 2010 Highlander led to her death, saying that Texas law requires claims for manufacturing defects to cite more than just deviation from the automaker's performance standards.

    The widower of a crash victim urged the Fifth Circuit on Wednesday to revive his suit alleging a faulty Toyota Motor Corp. airbag caused his wife's death, arguing that failures in Toyota's manufacturing, designing and testing of its products made her death "predictable."

    Toyota Asks 5th Circ. To Toss Fatal Airbag Defect Appeal

    Toyota Motor Corp. on Wednesday asked the Fifth Circuit to affirm dismissal of a suit brought by the widower of a crash victim, saying the plaintiff relied on flawed arguments in his claim that a faulty Toyota Highlander airbag caused his wife's death.
