The Eleventh Circuit ruled Wednesday that the due process rights of tobacco companies are not violated when juries in smokers' trials rely on the original Engle jury's determinations to find for individual plaintiffs on their claims that the companies concealed the health risks of smoking to the public.

Tobacco Cos. Ask 11th Circ. To Reverse $3M Punitive Award
R.J. Reynolds Tobacco Co. and Philip Morris USA Inc. on Wednesday asked the Eleventh Circuit to reverse a $3.34 million punitive damages award in an Engle progeny case, saying that the plaintiff could not rely only on Engle findings to establish punitive damages.
