9th Circ. OKs Nix Of Adema Suit Under Forum Choice Clause
The Ninth Circuit has held that a California district court didn't err by dismissing Adema Technologies Inc.'s suit against German chemical supplier Wacker Chemical Corp. over alleged violation of a supply agreement per a clause restricting litigation to Germany, saying it's not unduly burdensome for Adema.

Adema's Solar Contract Suit Belongs In Germany, Wacker Says
German chemical supplier Wacker Chemical Corp. urged a California federal judge on Thursday to toss solar-panel-maker Adema Technologies Inc.'s suit claiming Wacker violated a supply contract by refusing to cut Adema's price after flooding the market with cheap polysilicon, arguing the agreement restricts such litigation to Germany.
