The Ninth Circuit on Tuesday upheld the dismissal of a proposed class action alleging eBay Inc.'s automatic bidding service unfairly limits sellers' earning potential when they sell items via the website, finding the plaintiff misinterpreted eBay's user agreement.

EBay Inc. sellers urged the Ninth Circuit on Wednesday to revive their contract suit accusing the online auction site of meddling with bids and falsely claiming it doesn't come between sellers and buyers, arguing that the lower court was wrong to find that they had misinterpreted eBay's user agreement.
