A California federal judge on Monday trimmed Lions Gate Entertainment Corp. subsidiary Summit Entertainment LLC's trademark infringement counterclaim against the producers of "Twilight" parody "Twiharder," but allowed Summit to proceed with copyright infringement and trademark dilution counterclaims, saying the First Amendment doesn't offer parodies unconditional protection.

A California federal judge Monday tossed a $6.5 million damages claim brought by producers of the "Twilight" parody film "Twiharder" alleging Lions Gate Entertainment Corp. subsidiary Summit Entertainment LLC had tried to prevent the parody's distribution with "sham" cease-and-desist letters, saying the producers couldn't show the studios had acted maliciously.

Lions Gate Entertainment Corp. filed trademark and copyright infringement counterclaims Monday in California federal court over a "Twilight" parody film, firing back in an antitrust lawsuit filed by the film's producers over Lions Gate's IP enforcement practices.
