A Mississippi federal judge on Thursday tossed a discrimination lawsuit filed by the Equal Employment Opportunity Commission against a Vicksburg, Mississippi, hospital, holding the commission failed to meet its burden that an injured nurse was protected by the Americans with Disabilities Act.

The Equal Employment Opportunity Commission fought back Monday in Mississippi federal court as a hospital sought to put an abrupt end to an Americans With Disabilities Act discrimination suit, saying it had raised genuine questions over whether the hospital unfairly fired a long-time employee.
