Kauai County and four public health advocacy groups this week appealed to the Ninth Circuit a Hawaii federal judge's decision siding with agribusiness units of Syngenta AG, BASF SE and other companies that the county's restriction on the cultivation of genetically modified crops was invalid and preempted by state law.

Agribusiness units of DuPont Co., Dow Chemical Co. and Syngenta AG asked a federal court on Friday to void a Hawaii county's effort to legislate the cultivation of genetically engineered crops, saying the measure "irrationally" punishes them despite mountains of research proving GMOs are safe.
