Genband US LLC asked Judge Rodney Gilstrap of the Eastern District of Texas on Tuesday to consider additional evidence that rival Metaswitch Networks Corp.’s infringement of its telecommunications patents caused it irreparable harm meriting a permanent ban on sales in a remand of its case from the Federal Circuit.

A Texas federal jury on Friday found that Metaswitch Networks Corp. infringed seven patents held by Genband US LLC covering firewall and networking technology and awarded the communications software company approximately $8.2 million in damages.

A Texas federal magistrate judge recommended a pair of Genband firewall and network patents that Metaswitch Communications allegedly infringed should survive the Supreme Court's Alice test for abstraction in patents Wednesday, setting the stage for a jury trial next week.
