A Montana federal judge on Tuesday denied a bid from Aspen Way Enterprises Inc. to escape a coverage battle stemming from underlying allegations that the franchisee installed privacy-violating software on customers’ computers, saying that independent monetary claims preclude the court from dismissing the case.
