A Pennsylvania corrections officer has asked the Third Circuit to reconsider its split ruling that her meal breaks weren't compensable under federal labor law, arguing Tuesday that the majority's decision defied federal appeals court precedents on methods for determining compensability.

The Third Circuit in a split ruling Tuesday upheld a lower court's decision to dismiss a lawsuit filed by Pennsylvania prison guards, adopting for the first time a test to determine whether a meal period is compensable under the Fair Labor Standards Act.
