An auto parts importer on Thursday failed to win dismissal of an amended complaint in California federal court from Hyundai Motor America Inc. alleging the importation of falsely marketed Hyundai-branded auto parts, because the court found that Hyundai sufficiently alleged the parts are nongenuine gray market goods.

A California federal judge has dismissed Hyundai Motor America Inc.'s suit accusing Pinnacle Group LLC of importing and selling Hyundai-branded auto parts and falsely marketing them as genuine, ruling that Hyundai's trademark, unfair competition and other claims are conclusory and not supported by sufficient facts.

Hyundai Motor America Inc. on Monday urged a California federal judge to reject a bid to toss its suit accusing Pinnacle Group LLC of importing and selling Hyundai-branded auto parts and falsely marketing them as "genuine," saying it isn't trying to shut down competition but rather stop the illegal activity from continuing.
