A California federal judge on Thursday kept Ariosa Diagnostics Inc.'s counterclaims against DNA analysis company Illumina Inc. intact as Ariosa fights back against accusations that its prenatal Down syndrome test infringes an Illumina patent, ruling that a contract does not force Ariosa into arbitration.

DNA analysis company Illumina Inc. hit Ariosa Diagnostics Inc. with a patent suit in California federal court on Friday alleging the prenatal diagnostics company's prenatal test meant to detect Down Syndrome infringes on an Illumina patent.
