A federal judge kept developer Mikart Inc. on the hook for allegedly costing Pisgah Laboratories Inc. $100 million in lost profits by not performing on a contract to develop an anti-abuse version of Vicodin, ruling Thursday that Pisgah presented enough evidence to overcome the dismissal motion.

Pisgah Laboratories Inc. is seeking at least $100 million in damages from Mikart Inc. for allegedly breaching a contract to develop tablets containing Pisgah's patented anti-abuse version of the narcotic pain reliever Vicodin, according to a suit removed to North Carolina federal court Thursday.
