A Delaware federal judge on Monday awarded Frank LLP, Prickett Jones & Elliott PA and Hausfeld LLP $3 million in attorneys' fees in connection with Hartig Drug Co.'s suit settled earlier this year against Allergan Inc., Senju Pharmaceutical and Kyorin Pharmaceutical over claims the companies engaged in product-hopping for eye treatment products.

The Hartig Drug Co. Inc. has asked a Delaware federal judge to award it $3 million in attorneys' fees in a suit against Allergan Inc., Senju Pharmaceutical Co. Ltd. and Kyorin Pharmaceutical Co. Ltd. alleging product-hopping over eye care products Zymar and Zymaxid.

Allergan Inc., Senju Pharmaceutical Co. Ltd. and Kyorin Pharmaceutical Co. Ltd. have agreed to pay Hartig Drug Co. Inc. $9 million to end a putative class action alleging product-hopping over eye care products Zymar and Zymaxid, according to documents filed Friday in Delaware federal court.

A Delaware federal judge on Wednesday dismissed a product-hopping suit against Allergan Inc. over eye care products Zymar and Zymaxid after concluding the pharmacy chain that brought the putative class action did not have the right to sue as a direct purchaser under federal law.
