A California federal judge was urged Friday to nix Macy's Inc. and denim company Citizens of Humanity LLC's bid to toss a putative class action alleging they falsely market their jeans as being made entirely in the U.S., arguing the state's "Made in USA" statute is not preempted by federal law.

Macy's Inc. and denim company Citizens of Humanity LLC on Tuesday urged a California federal judge to throw out a proposed class action accusing them of falsely marketing that their jeans are made entirely in the U.S., saying the state statute the plaintiffs rely upon is antiquated and preempted by federal law.

The lead plaintiff in a putative consumer class action urged a California federal judge on Thursday to nix a bid by denim company Citizens of Humanity LLC and Macy's Inc. to dismiss the suit accusing the companies of improperly marketing certain jeans as made entirely in the U.S., saying the suit isn't preempted by federal law.

Denim company Citizens of Humanity LLC and Macy's Inc. were hit with a putative class action Monday in California federal court accusing them of misleading customers into thinking COH's "Boyfriend" jeans were made entirely in the U.S. when the jeans' fabric, thread and buttons were actually made abroad.
