A Sixth Circuit panel on Thursday said it would not rehear an appeal from five major railroad companies over a Tennessee tax on diesel fuel they claimed was unlawful, confirming that a trial court would decide if the tax is valid.

A Tennessee federal court on Friday allowed BNSF Railway Co. to stop paying railroad diesel taxes temporarily while it appeals the court's Oct. 10 denial of its preliminary injunction to the Sixth Circuit.
