A Florida federal judge on Thursday kept intact most of a proposed class action accusing Wal-Mart Stores Inc. of misleading consumers by marketing a juice drink as "100% cranberry pomegranate" when it is actually a blend of five fruit juices with very little pomegranate, ruling the state laws claims were not preempted by federal law.

Wal-Mart Stores Inc. misleads consumers by marketing its Great Value brand "100% cranberry pomegranate" juice as being wholly composed of the two fruits when it is actually made up of five fruit juices and contains very little pomegranate, according to a putative class action filed on Thursday in Florida federal court.
