A Georgia federal judge on Friday ruled that Liberty Surplus Insurance Corp. cannot duck coverage for Norfolk Southern Railway Co. subsidiaries for claims arising from a 2011 car-train collision in the state, saying there's no exclusion in a contractor's policy for property owned by a subsidiary.

An insurance company told a Georgia federal judge Wednesday that a railroad line has not proven its case in a coverage dispute between the two companies, saying the insurer is not liable for claims from a 2011 car-train collision because it happened on tracks owned by a subsidiary of the railroad.

A railway company on Monday told a Georgia federal judge that Liberty Surplus Insurance Corp. is trying to skirt coverage for claims arising from a 2011 car-train collision, saying that the insurer can't show its policy excludes the subsidiary that owns the crossing at the accident site.
