    TCPA Suits Bolstered By 3rd Circ. 'Called Party' Ruling

    The Third Circuit's decision Wednesday that consumers who answer prerecorded phone calls intended for their roommates can bring suits under the Telephone Consumer Protection Act is likely to further swell the already bulky class action docket, by stripping businesses like Bank of America of their ability to knock down suits in their early stages, attorneys say.

    A man who answered a prerecorded call from Bank of America meant for his roommate can sue the bank under the Telephone Consumer Protection Act even though he was not the intended recipient, the Third Circuit ruled Wednesday, reversing a federal judge's order.
