The Sixth Circuit on Thursday nixed a lawsuit by a group of Michigan business owners who claimed Marathon Petroleum Co. LP's expansion of an oil refinery robbed them of their customer base and caused increased air pollution that interfered with their operations.

A group of Detroit business owners on Wednesday told a Michigan federal court that they would be appealing the court's decision to dismiss their case accusing Marathon Petroleum Co. of maliciously interfering with their business operations and increasing air pollution to the Sixth Circuit.

A Michigan federal judge dismissed a complaint Tuesday from Detroit business owners accusing an oil refinery of increasing air pollution with the expansion of its facilities to process tar sands, ruling that the plaintiffs failed to state a viable claim for relief.
