Continental Casualty Co. on Wednesday asked a California federal judge to declare it has no obligation to pay a damage award won by UPS Supply Chain Solutions Inc. in underlying litigation over stolen disk drives, arguing that its liability policies insure physically damaged property but not theft.

UPS Supply Chain Solutions Inc. can proceed with a claim against Alterra Excess & Surplus Insurance Co. seeking payment for a judgment entered in underlying litigation over stolen disk drives, a California federal judge ruled Wednesday, saying UPS adequately alleged that the judgment arose from a risk covered under Alterra's policies.
