Kmart Says Gymboree Clothing Designs In Public Domain
Kmart Corp. and Bon-Ton Stores Inc. have fired back at children apparel chain Gymboree Corp.'s copyright suit alleging the retailers are selling copy-cat clothing, saying Wednesday in California that Gymboree's designs have entered the public domain.

Children's apparel retailer Gymboree Corp. hit Kmart Corp. and Bon-Ton Stores Inc. with a lawsuit on Tuesday accusing the two major retailers of stocking their shelves with copyright-infringing clothing.
