Liquor distributor Allied Lomar Inc. will not be getting a third trial over a distillery's use of "cowboy" on competing bourbon, after Texas federal jurors in January found the distributor abandoned its trademark for "Cowboy Little Barrel" bourbon through disuse.

Lone Star Distillery LLC did not infringe a rival's trademark for the word "cowboy" by selling bourbon with the word in its name, a Texas federal jury ruled Wednesday, following a December false start that ended in a mistrial.
