Riddell Inc. on Monday told a West Virginia federal court it should toss a proposed class action alleging the sports equipment maker overcharged for football helmets in light of a recent Fourth Circuit ruling that false advertising claims cannot stand when there is at least one expert to support the advertised claims.

A West Virginia judge on Thursday refused to throw out a proposed class action claiming Riddell Inc. overcharged for football helmets based on the results of a bogus concussion study, rejecting the company's argument that a youth league can't be considered a "consumer."

A youth football organization Friday amended its proposed class action accusing Riddell Inc. in West Virginia federal court of falsely marketing its helmets, specifying instances in which Riddell cited a disputed study saying the helmets reduce the risk of concussions.
