A California federal judge on Monday tentatively dismissed a vending machine company's suit claiming The Hershey Co. stifles competition in the candy market by paying unearned rebates to a rival, saying "there seems to be just very good reasons for Hershey in doing what it's doing."

A California federal judge on Monday tentatively refused to dismiss a vending machine company's allegations that The Hershey Co. is stifling competition in the snacks market by paying unearned rebates to a rival, saying the companies need to gather more facts before he'll consider throwing out the case.
